ORDER The petitioner is sole accused in SplSC.No.42 of 2022 on the file of the learned Sessions Judge, Mahila Court, Tiruchirappalli. The trial Court, by its
judgment dated 29.09.2025, found the petitioner guilty, convicted and sentenced to undergo 200 years of rigorous imprisonment with a fine of Rs.20,000/- and in default to undergo six months simple imprisonment for the offence under Section 5(I), 5(I)(ii) r/w 6 (I) of the POCSO Act. Challenging the
judgment of conviction and sentence, the petitioner has filed an appeal before this Court in Crl.A(MD)No.1209 of 2025 and the same was admitted by this Court. Along with the appeal, the petitioner has filed this petition to suspend the sentence imposed by the trial Court. 2.Heard the learned counsel on either side 3.Since the DNA test proved that the petitioner is the biological father of the child, this court is not inclined to entertain this petition.
