Dutta, learned counsel for the petitioner. Also Mr. A.K. Ghosh, learned Standing Counsel, P&RD Department; Mr. B. Sharma, learned Standing Counsel, Accountant General for the respondent No.3; Ms. S. The present writ petition has been filed by the petitioner whose late husband was employed as a Muster Roll Worker under Binnakandi Anchalik Panchayat as a Tax Collector. In terms of the directions contained in the judgment and order dated 08.06.2017 passed in Writ Appeal No.45/2014 (State of Assam Vs. Upen Das) the cases of the petitioner along with the other Page No.# 3/4 similarly situated persons were duly considered and the benefits were conferred. Amongst the benefits conferred by the order dated 15.10.2020, the employees whose cases were considered to be covered by the Pradhan Mantri Suraksha Bima Yojna, Pradham Mantri Jeevan Jyoti Bima Yojna, Atal Amrit Abhiyan and the premium for the same will be paid by the State Government. In the said order the name of the petitioner’s late husband appears at Serial No. 43 (page No.14 of the writ petition). Since the petitioner did not receive the benefits entitled to her late husband she filed representation before the Chief Executive Officer, Nagaon Zila Parisad, the President of Nagaon Zila Parisad, Block Development Officer of Binnakandi, Doboka Town District- Hojai and Commissioner and Secretary, P&RD Department, Juripar, Panjabari, Guwahati. According to the petitioner the said representation was sent by Speed Post and the postal receipts of the same are also enclosed to the writ petition. Inspite of the representation filed by the petitioner before the authorities mentioned above, no reply was forthcoming therefore, the present writ petition has been filed. 3. The learned counsel for the respondents submits that in terms of the order dated 15.10.2020, the benefits conferred on the employees mentioned in the list have already been conferred upon and there is no reason why the petitioner’s late husband will not be conferred the benefit. However, presently the learned counsel for the respondents submits that he does not have any instructions. 4. Considering the submissions made and upon perusal of the writ petition, this Court of the considered view that the writ petition can be disposed of at this stage without issuing notice as the representation stated to have already been Page No.# 4/4 filed by the petitioner and the same is pending before the authorities concerned. Therefore, without expressing anything on merit and without issuing notice at this stage, this writ petition stands disposed of, directing the Commission & Secretary, P&RD Department namely the respondent No.1 to expeditiously take up and disposed of the representation dated 21.04.2026 stated to have been filed by the petitioner and submitted by way of Speed Post. The postal receipts of which are also enclosed to the present writ petition. Upon considering the claims made by the petitioner, if it is found to be justifiable the respondent Commissioner & Secretary, P&RD Department namely respondent No.1 will pass appropriate orders for release of the benefits to the petitioner in respect of the claims of her late husband. 5. With the above observations, this writ petition stands closed. 6. The Commissioner & Secretary will consider and pass appropriate orders within a period of 45 (forty five) days from the date of receipt of certified copy of this order and in the event any order has already been passed the copy thereof, should be furnished to the petitioner.
