ORDER The present petition has been filed by A4 in Crime No.757 of 2023, on the file of the first respondent police seeking to quash the FIR, wherein the petitioner is charged with the offences under Sections 120(B), 406 & 420 of IPC and Sections 3, 5, 21(1), 21(2), 21(3), 23 and 25 of the Banning of Unregulated Deposit Schemes Act, 2019 and Section 5 of Tamil Nadu Protection of Interest of Depositors (in Financial Establishment) Act, 1997.
2. A perusal of the FIR reveals that the petitioner has canvassed on behalf of a Company which had defaulted in the repayment of the deposit amount.
3. According to the learned counsel appearing for the petitioner, the petitioner is also one of the victim and he had deposited huge amount and lodged a complaint before the respondent police on 03.08.2023. Instead of 2/5 https://www.mhc.tn.gov.in/judis
Crl.O.P.(MD).No.15674 of 2026. registering an FIR under the said complaint, the respondent authorities have implicated him as an accused and registered an FIR on the basis of the complaint lodged by the other depositors.

The learned counsel for State of Tamil Nadu (Crl.Side) appearing for the first respondent submitted that there are 106 victims and almost all of them have implicated the petitioner herein to the effect that he had participated in the meetings and canvassed with the other victims. He further submitted that already steps have been taken to attach the properties of the petitioner herein. He further submitted that the properties of the other accused persons have already been provisionally attached under Section 3 of the TANPID Act.
5. Heard the learned counsel appearing for the petitioner and perused the materials available on record.
6. As could be seen from the charge sheet, the petitioner is said to have canvassed on behalf of the Company and lured the other investors to invest huge money in the Company run by the first accused herein. In fact a reading 3/5 https://www.mhc.tn.gov.in/judis
Crl.O.P.(MD).No.15674 of 2026. of the complaint of the petitioner dated 03.08.2023 also reveals that the petitioner had canvassed on behalf of the Company.
7. In such circumstances, this Court does not find any reason to interfere with the investigation. However, the respondent police authority is
directed to consider the complaint lodged by the petitioner dated 03.08.2023 and initiate appropriate action.
8. With the above said observation, this Criminal Petition is disposed of. Consequently connected Miscellaneous Petition is closed.
