A perusal of the records reveal that the present petitioner is an accused in S.T.C.No.995 of 2025, which has been filed under Section 138 r/w. Section 142 of Negotiable Instruments Act. Though P.W.1 was already cross examined, the present application has been filed for the purpose of further cross examination. 3. Considering the fact that the reasons assigned in the application does not reveal any legally acceptable reason for recall P.W.1, the trial Court has chosen to dismiss the application. Challenging the same, the present Criminal Original Petition has been filed. 4. This Court has perused the petition filed by the petitioner/accused as well as the order passed by the trial Court. 5. A perusal of the order of the trial Court reveals that the application has been filed in a belated stage and it has been filed with an intention to drag on the proceedings and this Court does not find any reason to interfere with the order of the trial Court.
