CMP No.1696/2026 & CMP(M) No.70/2026 The present applications under Order 1, Rule 10 read with Section 151 of CPC and under Section 5 of the Limitation Act, have been filed for deleting the name of respondent No.1 (1-a), i.e. Prem Devi, on account of her death on 17.06.2022 as her legal representatives are already on record, as respondents No.1 (1-b) to 1(1-g), after condonation of delay and setting aside the abatement. No reply(ies) is/are intended to be filed to these applications. Heard. Having regard to the averments made in the applications, which are duly supported with the affidavits of respondent No.1(1-b)-Suresh as well as death certificate of respondent No.1(1-a), the same are allowed and the name of respondent No.1(1-a)- Prem Devi is ordered to be deleted from the array of the parties, subject to all just exceptions. Amended memo of parties, filed alongwith the application (CMP No.1696 of 2026), is ordered to be taken on record. The applications stand disposed of.
