ORDER The Appellant in CRL.A.(MD)No.570 of 2025 has filed this application seeking relaxation of the condition imposed by this Court in Crl.M.P.(MD) No.6461 of 2025, dated 09.05.2025. 2.While entertaining the appeal filed by the appellant in CRL.A.(MD) No.570 of 2025, this Court, by order dated 09.05.2025 in Crl.M.P.(MD) No.6461 of 2025, suspended the sentence imposed by the trial Court, by imposing the following conditions:-
“i) The petitioner shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum of Rs.25,000/- (Rupees Twenty Five Thousand only) to the satisfaction of the Chief Judicial Magistrate, Pudukkottai. ii) The petitioner shall appear and sign before the Chief Judicial Magistrate, Pudukkottai, on the first working day of every English calender month at 10.30 a.m., until further orders. 2/5 https://www.mhc.tn.gov.in/judis
CRL.MP.(MD)No.15251 of 2026 iii) In case, the petitioner is unable to appear before the Court on the first working day of a month, he shall appear on the next working day. iv) The petitioner shall furnish his residential address and mobile number to the Chief Judicial Magistrate, Pudukkottai.” 3.The petitioner has now filed the present petition seeking modification of Condition No.2, which requires him to appear before the Chief Judicial Magistrate on the first working day of every English calendar month at 10.30 a.m., on medical grounds. 4.This Court, while imposing the said condition in its earlier
order dated 09.05.2025, had already taken note of the same and permitted the petitioner to appear before the Court on the next working day, if he was unable to appear on the first working day of the month. It was further observed that, if the petitioner was unable to appear either on the first working day or on the next working day due to medical reasons, he could file an appropriate 3/5 https://www.mhc.tn.gov.in/judis
CRL.MP.(MD)No.15251 of 2026 application before the concerned Sessions Court, obtain exemption, and appear on any other date in the month, as directed by the Sessions Court. 5.The said condition was imposed only to ensure the availability of the appellant during the pendency of the appeal. Therefore, this Court is not inclined to further relax the condition in toto. Accordingly, this criminal miscellaneous petition is dismissed.
