Page No.1 of 4 https://www.mhc.tn.gov.in/judis WP.Crl(MD)No.4205 of 2026 For Petitioner : Mr.K.A.S.Prabhu For Respondents : Mr.D.Venkatesh Counsel for State of Tamilnadu (Crl.Side) O R D E R [Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] Challenging the order dated 16.07.2026 passed by the 1st respondent granting 6 days emergency leave to the convict prisoner with escort, the petitioner has filed this writ petition to allow the convict prisoner to go on leave for 6 days without escort. 2. When the matter was taken up for hearing today, the learned counsel for the State of Tamil Nadu(Crl.Side) submitted that the Intelligence report says that there is a possibility of the convict prisoner escaping from the Prison. He further submitted that the petitioner had earlier approached this Court in W.P.Crl(MD)No.2412 of 2026 and this Court taking into consideration the apprehension expressed by the respondents, had granted 3 days emergency leave to the convict prisoner with single escort. He further submitted that the said apprehension still continues and therefore, the convict prisoner may be permitted to go on leave with one escort. Recording the above submission of the learned counsel for the State of Tamil Nadu(Crl.Side), the impugned order dated 16.07.2026 is modified to the extent that the convict prisoner is permitted to go on 6 days of emergency leave with one escort. The other conditions imposed in the impugned order dated 16.07.2026 shall stand as it is. 4. Accordingly, the Writ Petition (Criminal) is disposed of.
