O.P.(MD) No.14791 of 2026 ORDER The present petition has been filed seeking to quash the charge sheet in C.C.No.913 of 2022, on the file of the learned Judicial Magistrate, Manamadurai, wherein the petitioner is charged with the offence under Sections 147, 148, 294(b), 324 and 506(2) of IPC. 2. When the matter came up for hearing today, the defacto complainant namely Lakshmanan has filed an affidavit. Paragraph 6 & 7 of the affidavit are extracted as follows:- “6. I respectfully submit that the Petitioners submit that they never committed any offence as alleged by the respondent police. The facts of the case is that on 12.04.2017, at about 04.00 p.m., due to the previous motive there is a wordy quarrel against the petitioners and the defacto complainant and case in counter between both parties and they are also relatives in the same villagers and they are amicably settled the issue the above said matter in Crime No.160 of 2017 for the alleged offence under Sections 147, 148, 294[b], 324, 506 [ii] of IPC and one Crime No.161 of 2017 for the alleged offence under Sections 147, 148, 294[b], 324, 506 [ii] and 379 of IPC and the charge sheet has been filed in C.C.No.913 of 2022 and the same is pending before the learned Judicial Magistrate, Manamadurai in Crime No.161 of 2017 no charge sheet is filed till now. 2/4 https://www.mhc.tn.gov.in/judis Crl. In view of the affidavit filed by the defecto complainant, the charge sheet in C.C.No.913 of 2022, on the file of the learned Judicial Magistrate, Manamadurai, stands quashed not only as against the petitioner but also as against other accused persons who are non petitioners herein. 4.
