(2) Petitioner was initially engaged on daily wages basis in Public Works Department w.e.f. 1.11.1987 and he was thereafter regularised on the post of Work Agent on 10.8.2019. According to petitioner, he is entitled to be considered for promotion to the post of Junior Engineer in terms of the rules as modified on 17.9.2019. Reliefs sought in the writ petition are as under: “a) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent authorities to reconsider the claim of the petitioner for the post of draftsman notionally from the date when juniors to the petitioner have been promoted to the post of Draftsman in accordance with governing service rule of 2015. b) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondents authorities after giving notional promotion/benefit to the post of draftsman the claim of the petitioner may be considered for next promotional post i.e. Junior Engineer (Technical) and the petitioner be given all service benefits.” (3) Learned State Counsel submits that if petitioner makes representation to the competent authority for redressal of his grievance, then the same shall be dealt with as per law. (4) Writ petition is, accordingly, disposed of granting liberty to petitioner to make representation to the competent authority. If he makes representation within two weeks from today, decision thereupon shall be taken, as per law, within eight weeks thereafter.
