Both the parties present. The counsel for the appellant/s Mr.S.Baskar Muthuram and the counsel for the respondent/s Mr.K.Hemakarthikeyan are present. After mutual discussion, negotiation, mediation and conciliation between both parties and with the assistance of the Bench, both sides consented for settlement. AWARD Both the parties along with their counsels are present. The respondent submits that she runs a Self-Help Group. Out of the amount so received, she paid a sum of Rs.10,00,000/- to the petitioner. However, as on date, she suffers with some ailment and she wants to settle the issues as she is a labour. The petitioner replied that she had borrowed only an amount of Rs.4,00,000/-. But, the total cheque claimed by the respondent is Rs.10,00,000/-. Further she submits that, she had already handed over 5 sovereigns of gold jewels and also chit amount. However, she has no proof for the same. The petitioner and the respondent are close relatives. After deliberations, the petitioner agreed to settle the issue, since she is also employed as Assistant in Agriculture Department, Vada Madurai. She further submits that she also looks after her children. The respondent submits that she is a daily wager and for the recovery of the amount, she has been before this Court all these years. After deliberations, the petitioner agreed to settle an amount of Rs.8,25,000/- as full time settlement. Already on 30.03.2023 and 18.12.2024, she had deposited an amount of Rs.2,50,000/- each before the learned Additional District Munsif Cum Judicial Magistrate Court, Vedasandur. The said amount is permitted to be withdrawn by the respondent with accrued interest, if any.
If any application is filed by the respondent in this regard, the learned Trial Court is directed to hand over the said amount within a period of two weeks from the date of her application, since she already suffered with ailment and being a daily wager. For the balance amount of Rs.3,25,000/-, the petitioner is directed to pay the same within a period of three months from the date of receipt of copy of this order to the bank account of the respondent through her counsel by giving prior intimation. If there is any deviation on her part, the respondent is at liberty to proceed with the execution of the order Further, it is made clear that, there is no further claims between the parties. https://www.mhc.tn.gov.in/judis
On payment of the entire amount, the sentence imposed to the petitioner is liable to be set aside. 2. Post this case before the Court for setting aside the conviction and sentence. The full Court fee paid shall be refunded to the appellant in the manner provided under Section 69-A of the Tamilnadu Court Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994. The Original of the award shall be place in the court record and copy of the award, kept with High Court Legal Services Committee and one copy each is furnished to both parties free of cost. In agreement of the above, both parties and their counsel have affixed their signatures/ thumb impressions in presence of the Lok Adalat Bench admitting the terms and today conditions and accordingly, the award is passed.
