No.15523 of 2026 ORDER : The Court made the following order :- The petitioners/A1 to A4, who apprehend arrest at the hands of the respondent police for the offence under Section 303(2) of BNS, 2023 r/w Section 21(5) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.132 of 2026, on the file of the respondent Police, seek anticipatory bail. 2.The allegation against the petitioners is that on 13.07.2026, at about 06.00 a.m., on receipt of a complaint from the Village Administrative Officer, Kudipatti Village, regarding the illegal sand mining, the respondent intercepted the tipper lorry bearing Registration No.TN 59 AT 3663 and found that the petitioners were illegally quarrying two units of red soil from Vandapuli Kanmai. Hence, the case has been registered. 3.The learned counsel for the petitioners submitted that the petitioners are innocent and they have not committed any such offence as alleged by the prosecution and they have been falsely implicated in this case. The learned Counsel for State of TN (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that investigation in this case is still pending and except the petitioners 1 to 3, one previous case is pending against the four petitioner. However, he opposed to grant anticipatory bail to the petitioners. 5. Considering the above facts and circumstances of the case, the petitioners have illegally quarried sand from Kanmai which is the lifeline of various villages and since they also caused damage to the ecology and water body, this Court is not inclined to grant anticipatory bail to the petitioner. 6.
