BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED: 24.07.2026 CORAM THE HONOURABLE MR JUSTICE A.D.JAGADISH CHANDIRA AND THE HONOURABLE MS.JUSTICE R. POORNIMA WP Crl.(MD)No.4140 of 2026 Jeba Petitioner(s) Vs. 1. The Deputy Inspector General of Prison, O/o. The Deputy Inspector General of Prison and Correctional Services, Madurai Range, Madurai Central Prison Campus, New Jail Road, Madurai. 2. The Superintendent of Prison, Central Jail, Madurai. 3. The Superintendent of Police, O/o. The Superintendent of Police, Dindigul District. 4. The Inspector of Police, O/o.The Inspector of Police, Oddanchatram Police Station, Dindigul. Respondent(s) For Petitioner(s): Dr.Lakshmi Prasanna Komara For Respondent(s): Mr.D.Venkatesh Counsel for State of Tamilnadu (Crl.Side) Prayer: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records passed by Respondent No.l in No. 352179/Tha.Ku.4/2025 dated 04.07.2026 and quash the same as bad in law and in the nature of writ directing the Respondents Nos.1 and 2 to grant emergency leave without escort for a period of 15 days to the petitioner’s father namely Kangaraj s/o Abraham (PID No:352179) who is languishing in the Madurai Central Prison. https://www.mhc.tn.gov.in/judis ORDER (Order of the Court was made by the Hon'ble A.D.JAGADISH CHANDIRA, J.) Challenging the rejection order passed by the 1st respondent in No.352179/Tha.Ku.4/2025 dated 04.07.2026, this writ petition has been filed to quash the same with a consequential direction to the 1st respondent to grant 15 days emergency leave to the petitioner's father namely, Kangaraj s/o Abraham (PID No:352179) who is languishing in the Madurai Central Prison. 2. The learned Counsel for State of Tamilnadu (Crl.Side) would submit that the petitioner seeks emergency leave without escort for 15 days to her father / convict prisoner on the ground that her father's presence is required to redeem the jewels pledged in his name and to arrange funds for her marriage. However, as per Rules 6 and 9 of the Tamil Nadu Suspension of Sentence Rules, 1982, only to attend the funeral of the blood relatives or to visit the relatives who are in their death-bed or serious condition and to attend the marriages of their sibling or children, emergency leave can be granted and therefore, the convict prisoner is not entitled to emergency leave. Thus, the learned Counsel for State of Tamilnadu(Crl.Side) would submit that the impugned order does not require any interference. He would also submit that the respondents have been wrongly cited in the cause title of this writ petition. 3. In view of Rules cited in the impugned order, we do not find any infirmity in the impugned order. https://www.mhc.tn.gov.in/judis 4. The Writ Petition(Criminal) is accordingly dismissed.
