Present bail application is moved by the applicant, who is in judicial custody in connection with Special Sessions Trial No.02 of 2020 (FIR No.55 of 2019), under Section 2/3 of the U.P. Gangsters and Anti-Social Activities (Prevention) Act, Police Station Vanbhoolpura, District Nainital. 4. Learned counsel for the applicant submits that according to the FIR six cases have been shown against the applicant and in all the cases applicant is on bail. She submits that as per the gang chart, the applicant shown member of Gang but he is not a member of any gang and has falsely been implicated; he is in judicial custody since 24.11.2022. She further submits that if applicant is enlarged on bail, he is ready to abide by the terms and condition imposed by this Court. 5. Learned State counsel has vehemently opposed the bail application. 6. Having considered the overall facts and circumstances of the case and perusing the material available on record, this Court is of the view that applicant is entitled to be released on bail. 7. Accordingly, bail application is allowed. Let the applicant-Danish @ Mota be released on bail on his executing a personal bail bond of Rs.40,000/- and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned subject to the condition that applicant will ensure his presence before concerned court below in every 14 days and will cooperate in the trial proceedings. 8.
