THIS WRIT PETITION, COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:

ORAL ORDER
The present writ petition is filed questioning the order dated 24.06.2022 passed in M.A.No.6/2021 by the Senior Civil Judge and JMFC, Byadagi and the order dated 31.08.2022 on I.A.No.1 and 2 passed in O.S.No.120/2021 by the Principal Civil Judge and JMFC, Byadagi, whereby both the Courts have concurrently held that the petitioner is not entitled for injunction.
2. Both the learned counsels have argued the matter on merits. The suit is of the year 2021 and till 2026, there is no injunction and the matter is pending. At this stage, this Court is not inclined to go into that aspect and in the facts and circumstances this Court, without expressing anything on the merits of the matter, deems it appropriate to direct the Trial Court to dispose of the main suit itself as expeditiously as possible. Accordingly, this Court is passing the following:

ORDER (i) Accordingly, the writ petition is disposed off. (ii) This Court is not interfering with the orders passed by the Trial Court as well as the Appellate Court on the ground that the suit is of the year 2021 and till 2026 there is no injunction in favour of the petitioner and therefore, without expressing anything on the merits of the matter, the writ petition is disposed off with a direction that the Trial Court shall dispose off the suit as expeditiously as possible. (iii) All I.As., in this writ petition stand closed.
