Hussain, learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor for the State of Assam. 2. This is a Criminal Revision Petition filed by the victim, whereby she has challenged the order of the acquittal passed by the learned Sub-Divisional Judicial Magistrate (M), Gossaigaon in PRC Case No.523/2022. 3. The petitioner being the victim has a right to file an appeal under Section 430 of the BNSS, 2023. Therefore, the petitioner is advised to file an appeal before the Court of Sessions challenging the order of acquittal. 4. The delay in filing the Appeal shall be condoned by the learned Appellate Court. 5. With the aforesaid direction, this Criminal Revision Petition stands closed and disposed of.
