For Petitioner : Dr.R.Alagumani For R1 : Mr.K.Balasubramani, Standing Counsel For R2 & R3 : Ms.K.R.Shivashankari, Counsel for State O R D E R Challenging the impugned order dated 10.11.2025 issued by the first respondent, the petitioner has filed the present writ petition seeking a consequential direction to the first respondent to rectify the date of death (as 27.09.2025 instead of 29.09.2025) in the Death Certificate Reg. No. D-2025-33-19808-000132. 2. Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself. 3. The learned counsel appearing for the petitioner would submit that the petitioner was issued a Death Certificate by the respondent authorities. 2/6 https://www.mhc.tn.gov.in/judis W.P(MD)No.21463 of 2026 However, the date of death mentioned in the Death Certificate has been erroneously recorded as 29.09.2025, contrary to the Medical Certificate issued in Form 4A by the Medical Officer. Aggrieved by the incorrect entry in the Death Certificate, the petitioner has filed the present Writ Petition seeking appropriate directions for correction of the date of death. 4. Per contra, the learned Standing Counsel appearing for the first respondent would submit that, prior to the issuance of the Death Certificate, the petitioner had submitted an application specifically stating the date of death as 29.09.2025 and had enclosed the Medical Certificate issued by the Doctor reflecting the said date. Based on the particulars furnished by the petitioner and the supporting documents, the respondent authorities issued the Death Certificate. Thereafter, the petitioner sought modification of the date of death by producing another certificate issued by the very same Doctor. Accordingly, he prayed for appropriate orders. 5. This Court has carefully considered the rival submissions made on either side and perused the materials available on record. 3/6 https://www.mhc.tn.gov.in/judis W.P(MD)No.21463 of 2026 6. It is not in dispute that the petitioner himself had furnished the date of death as 29.09.2025 in the application submitted to the respondent authorities and had enclosed the Medical Certificate reflecting the very same date. Acting upon the particulars furnished by the petitioner, the respondents issued the Death Certificate. Thereafter, the petitioner sought correction of the date of death solely on the basis of another certificate issued by the very same Medical Officer. In the absence of any convincing material to establish that the entry in the Death Certificate was made due to an error attributable to the respondent authorities, this Court is not inclined to interfere with the impugned order. 7. Accordingly, the Writ Petition stands dismissed. No costs.
