After mutual discussion, negotiation, mediation and conciliation between both parties and with the assistance of the Bench, both sides consented for settlement. 1/4 https://www.mhc.tn.gov.in/judis AWARD This Criminal Revision Case is preferred against the judgment delivered by the learned Additional Sessions Judge, Kuzhithurai, Kanniyakumari District, made in C.A.No.25 of 2014, dated 02.11.2022 confirming the judgment and decree passed on 17.05.2014 in C.C.20 of 2005 on the file of the Judicial Magistrate Court No. I, Kuzhithurai. 2. The learned Judicial Magistrate No.1, Kuzhithurai, Kanniyakumari District, has convicted the revision petitioner and sentenced him to undergo one year Simple Imprisonment for the offence under Section 138 of Negotiable Instrument Act and directed to pay a sum of Rs.3,000/- in default to undergo a further period of three months Simple Imprisonment and the same was confirmed by the learned Additional Sessions Judge, Kuzhithurai, Kanniyakumari District. Aggrieved by the same, the present Criminal Revision Case has been filed before this Court. 3. Both parties are present today. On negotiation, both parties are agreed to resolve the dispute and accordingly, the defacto complainant agreed to compound the offence by withdrawing the amount of Rs. 2/4 https://www.mhc.tn.gov.in/judis 2,00,000/- (Rupees Two Lakhs), which has already been deposited by the petitioner/accused before the Trial Court at the time of granting suspension of sentence, as full quit and hence, the same is also permitted to be withdrawn by the defacto complainant. 4. Since the petitioner/accused has been convicted in this case, the matter shall be posted before the regular Court for setting aside the conviction and sentence passed by the Additional Sessions Judge, Kuzhithurai, Kanniyakumari District.
