When the matter was taken up for hearing, the learned Government Advocate appearing for the respondent police submitted that the petitioner had neither submitted any representation in person nor sent any representation by registered post seeking permission to conduct the Rose Recreation Club. It was further submitted that, without making any such request before the competent authority, the petitioner has approached this Court alleging police interference in the conduct of the said club. According to the learned Government Advocate, the present writ petition has been filed with a malafide intention and is therefore liable to be dismissed. 2/4 https://www.mhc.tn.gov.in/judis W.P.Crl.(MD)No.4160 of 2026 3. A careful perusal of the materials available on record makes it evident that the representation relied upon by the petitioner is not accompanied by any acknowledgment evidencing its receipt by the respondent police. In the absence of any material to establish that the representation was either submitted in person or despatched by registered post and received by the respondent police, the petitioner cannot seek a writ of mandamus on the premise of police inaction or interference. Accordingly, this Writ Petition is dismissed. 27.07.2026 NCC : Yes / No Index : Yes / No sm TO:- 1. The Superintendent of Police, O/o. The Superintendent of Police, Ramanathapuram District. 2.
