State of Uttarakhand Hon’ble Ashish Naithani, J. Mr. Tajhar Qayyum, learned counsel for the Applicant. 2. Mr. Chitrarth Kandpal, learned Brief Holder for the State. 3. Present bail application is moved by the applicant, who is in judicial custody in connection with FIR No.453 of 2025 under Section 64(1), 87 of BNS, Police Station Laksar, District Haridwar. 4. Learned counsel for the applicant submits that the relationship of the applicant and victim is consensual. He submits that at the time of incident the victim was major and almost attained the age of 20 years. He submits that there is huge contradiction in the statement of victim and father of the victim and both have not supported the prosecution story. He submits that applicant is in jail since last one year. He further submits that the victim and the applicant belong to the different religion and when police arrested the applicant, she stated that she loves the applicant and due to the family pressure she changed her statement. 5. Learned State counsel has vehemently opposed the bail application. 6. Having heard learned counsel for the parties and considered the material available on record, without going into the merits of the case as though the victim, who is a major, has stated in her statement that the physical relationship was made forcefully by the applicant without her consent apparently seems otherwise as per the photographs and chat between the victim and the applicant, thus this Court is of the view that applicant is entitled to be released on bail. 7. Accordingly, bail application is allowed. Let the applicant-Nabeel be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned. 8.
