1. Heard the learned counsels appearing on behalf of the parties.

Learned counsel for the petitioner submits that the petitioner is in custody since 05.10.2025 in connection with POCSO Case No. 110 of 2025 arising out of Itkhori P.S. Case No. 114 of 2025, registered under Sections 64, 75, 125(b), 351(2) and 351(3) of Bharatiya Nyaya Sanhita, 2023 and sections 4 and 8 of POCSO Act, now pending in the court of learned Addl. Sessions Judge-cum-Special Judge POCSO Act, Chatra.

Learned counsel for the petitioner further submits that the petitioner has been falsely implicated in this case and there is allegation in the First Information Report that the co-accused Vikash Kumar had taken the victim on his motorcycle. He submits that the petitioner is in custody since 05.10.2025.

Learned counsel for the opposite party- State, on the other hand, has opposed the prayer and has submitted that as per the First Information Report, Vikash Kumar took the victim to Itkhori Jungle

and left her and Suraj Kumar – the petitioner herein, came from behind and committed rape upon her on the point of knife. Thereafter, Vikash Kumar also tried to commit rape upon the victim, but when she started screaming, then Vikash Kumar took her on his motorcycle and went towards the road. The learned APP has also submitted that the victim has supported the allegation under section 183 of Bharatiya Nagrik Suraksha Sanhita and is student of class-9.

After hearing the learned counsel for the parties and considering the nature of allegation which is direct against the petitioner supported by the statement of the victim under section 183 of Bharatiya Nagarik Suraksha Sanhita, this Court is not inclined to enlarge the petitioner on bail and hence, this bail application is rejected. 6. A counter-affidavit has been filed on behalf of the State during the court proceedings, which is taken on record.

Learned counsel for the petitioner submits that the petitioner is in custody since 24.11.2025 .

Learned counsel for the petitioner, on instructions, seeks permission to withdraw this bail application.
9. Permission is accorded.
10. Accordingly, this bail application is dismissed as withdrawn.
