ORDER The present petition has been filed by a A3, A5 to A8 and A9 in Crime No. 161 of 2017, on the file of the 1st respondent police seeking to quash the FIR, wherein the petitioners are alleged to have committed offences under Sections 147, 148, 294(b), 324, 506(2) and 379 of IPC.
2. When the matter came up for hearing today, the defacto complainant namely Saravanan has filed an affidavit. Paragraph 6 & 7 of the affidavit are extracted as follows:-
“6. I respectfully submit that the Petitioners submit that they never committed any offence as alleged by the respondent police. The facts of the case is that on 12.04.2017, at about 04.00 p.m., due to the previous motive there is a wordy quarrel against the petitioners and the defacto complainant and case in counter between both parties and they are also relatives in the same villagers and they are amicably settled the issue the above said matter in Crime No.160 of 2017 for the alleged offence under Sections 147, 148, 294[b], 324, 506 [ii] of IPC and one Crime No.161 of 2/4 https://www.mhc.tn.gov.in/judis
Crl. O.P.(MD) No.14790 of 2026 2017 for the alleged offence under Sections 147, 148, 294[b], 324, 506 [ii] and 379 of IPC and the charge sheet has been filed in C.C.No.913 of 2022 and the same is pending before the learned Judicial Magistrate, Manamadurai in Crime No.161 of 2017 no charge sheet is filed till now.
7. I respectfully submit that for the above said I have no objection to allow the quash petition filed by the petitioners in the interest of justice.”
3. In view of the compromise reached between the parties, the FIR in Crime No.161 of 2017, on the file of the 1st respondent police stands quashed not only as against the petitioners herein but also as against the other accused persons who are non petitioners.
