Ms. Reema Rana, learned counsel for the revisionist. Mr. Prem Kaushal, learned counsel for the respondent. Mr. Mahesh Chandra Pant, learned counsel for the mediator. The case is taken up today before the National Lok Adalat. The parties are present in person before the Lok Adalat and are duly identified by their respective counsel. This revision arises out of the judgment and order dated 30.06.2022 passed by the learned Judicial Magistrate, Nainital, District Nainital, in Criminal Case No. 2015 of 2020, Mohd. Irfan vs. Naresh Negi, whereby revisionist was convicted and sentenced for 6 months R.I. along with fine of Rs.4.15 lakhs for the offence punishable under Section 138 of the Negotiable Instruments Act, 1881, as well as assailing the judgment and order dated 03.01.2025 passed by the learned Sessions Judge, Nainital, in Criminal Appeal No. 64 of 2022, Naresh Negi vs. State & Another. Before the Lok Adalat, the parties have agreed to settle the matter and have arrived at a compromise. The terms of the compromise are as follows:
“The revisionist has already paid Rs. 5,35,000/- (Rs. Five Lacs Thirty Five Thousand only) to the respondent/complainant. The revisionist has further paid Rs. 15,000/- (Rs. Fifteen Thousand) to the respondent/complainant today itself. Now the matter has been settled amicably between the parties and the respondent does not want to prosecute the revisionist.”
The terms of the compromise have been recorded in a separate compromise sheet which shall form part of the order.
The compounding application (IA No. 7 of 2026) has been preferred by the parties and, in view of the settlement arrived at between them, the compounding application is allowed. Consequently, the criminal revision is allowed, and the impugned judgment & order dated 03.01.2025 passed by the learned Court of Sessions Judge, Nainital, in Criminal Appeal No. 64/2022, Naresh Negi V/s. State of Uttarakhand and Another, as well as the impugned judgment & order dated 30.06.2022 passed by the learned Court of Judicial Magistrate, Nainital, District Nainital, in Criminal Complaint No. 2015/2020, Mohd. Irfan vs. Naresh Singh Negi, under Section 138 of the Negotiable Instruments Act, is hereby set aside.
