W.P(MD)No.21441 of 2026 2.This Writ Petition has been filed seeking to quash the notice dated 03.07.2026 issued by the first respondent and consequently direct the first respondent to provide an alternate space to the petitioners for putting up a temporary shed to run their vegetable shop and to provide an assurance to allot shops in the proposed building to be constructed at Muthukumarasamy Old Bus Stand, Karur. 3.The learned counsel appearing for the petitioners submitted that the petitioners were granted licence for putting up Tharaikadai at Muthukumarasamy Old Bus Stand, Karur, and they have been running the said Tharaikadai for the past 40 years. It is submitted that the existing building is in a dilapidated condition and the respondents have proposed to construct a new shopping complex at the said location. In view of the proposed construction, the petitioners are facing the threat of eviction. Hence, the present Writ Petition has been filed.

W.P(MD)No.21441 of 2026 4.The learned counsel appearing for the petitioners further submitted that the petitioners are willing to vacate the shop premises within a period of one week from the date of receipt of a copy of this order and hand over possession of the same to the respondent Municipality, enabling the Municipality to proceed with the construction of the proposed shopping complex. However, he prayed that a direction may be issued to the respondent Municipality to give preference to the petitioners in terms of Rule 316(11)(a), (b) and (c) of the Tamil Nadu Urban Local Bodies Rules, 2023, while allotting shops in the proposed building. 5.The learned Standing Counsel appearing for the respondent Municipality submitted that, if the petitioners vacate the shop premises, preference will be given to them in accordance with the provisions of the Tamil Nadu Urban Local Bodies Rules, 2023. It is further submitted that, if any vacant shop is available in the nearby area, the same may be considered for allotment to the petitioners. 5/8 https://www.mhc.tn.gov.in/judis
W.P(MD)No.21441 of 2026 6.Recording the said submission, this Writ Petition is disposed of with a direction to the respondent Municipality to consider providing any vacant shop, if available in the nearby area, to the petitioners, subject to availability and in accordance with law. Further, the respondent Municipality shall consider the claim of the petitioners for preferential allotment of shops in the proposed building in accordance with Rule 316(11)(a), (b) and (c) of the Tamil Nadu Urban Local Bodies Rules, 2023.
