ORDER : The Court made the following order :- The petitioner, who apprehends arrest in connection with Crime No.153 of 2026 on the file of the respondent police, registered for the offences punishable under Sections 296(b), 118(1) and 351(3) of the Bharatiya Nyaya Sanhita, 2023, seeks anticipatory bail.
2. The case of the prosecution is that, owing to an earlier occurrence between the parties, cases had already been registered against both the petitioner and the defacto complainant. It is alleged that, harbouring a grudge over the earlier incident, the petitioner once again waylaid the defacto complainant, attacked him with a wooden log, and caused injuries. Thereafter, the defacto complainant was admitted to the hospital, and upon his complaint, the present case came to be registered.
3. The learned counsel for the petitioner submitted that, owing to previous enmity, the petitioner has been falsely implicated in the present case. He further submitted that the petitioner is ready and willing to cooperate with the investigation and that the injured has already been discharged from the hospital. Per contra, the learned Counsel for State (Criminal Side) reiterated the prosecution case and submitted that, although the injured has been discharged from the hospital, the present occurrence is the second incident involving the same parties and the petitioner has repeatedly attacked the defacto complainant. He therefore opposed the grant of anticipatory bail.
5. This Court has carefully considered the rival submissions and perused the materials available on record.
6. Considering the nature and gravity of the allegations, the motive attributed to the petitioner, and the fact that the present occurrence is the second incident involving the same parties, this Court is of the view that, if the petitioner is granted anticipatory bail, there is every likelihood of his indulging in similar offences or interfering with the investigation. Accordingly, this Court is not inclined to grant the extraordinary relief of anticipatory bail. Hence, this Criminal Original Petition stands dismissed.
