JUSTICE V.SRISHANANDA) 1. Heard Sri.Amit Anandhalli, learned counsel on behalf of the Sri.S.G.Kadadakatti, learned counsel appearing for petitioner, Smt.Kirtilata R. Patil, learned High Court Government Pleader, appearing for respondent No.1-State and Sri.Vinayak Kulkarni, learned counsel appearing for respondent No.2. 2. The present petition is filed under Section 528 of the Bharatiya Nyaya Sanhita, 2023 (under Section 482 of the Code of Criminal Procedure Code) seeking the following relief: “Wherefore, it is most respectfully prayed that this Hon’ble Court may graciously be pleased to:- (I) Quash the proceedings in Crime No.63/2024 registered against the petitioner/accused No.1 for the alleged offences punishable under Sections 420, 468, 471 read with 34 of IPC by the Siruguppa Police Station in so far as petitioner/accused No.1 alone by allowing this petition, in the interest of justice. - 3 - HC-KAR NC: 2026:KHC-D:2121 CRL.P No. 101406 of 2025 (II) May pass such other suitable order/s as this Hon’ble Court may deem fit and proper in the facts and circumstances of the case to do complete justice.” 3. Facts in the nutshell which are utmost necessary for disposal of the present petitioner as under: 3.1. Respondent No.2-Lakshmi Devi lodged complaint with Sirguppa Police Station on 13.03.2024, which was registered as Crime No.63/2024. 4. The gist of the complaint averments would reveal that the land bearing Survey No.20A, Plot No.4, Devalapura Village, measuring 69 feet by 40 feet, was originally purchased by Lakshmi Devi from her vendor, Thyagaraja S/o Venkatsubbaya, for a sum of ₹11,000/- through a registered sale deed dated 14.10.1996. She subsequently sold the same plot to Karibassappa and Mariraja Gowda on 29.01.2024 through a registered sale deed for a sum of ₹16,00,000/-. 5. It is alleged that Surendra Reddy sold the same plot by falsely representing an unknown lady as Lakshmi Devi, committing impersonation and cheating, with the sale deed value being ₹2,10,000/- dated 29.10.2018. - 4 - HC-KAR NC: 2026:KHC-D:2121 CRL.P No. 101406 of 2025 6. Subsequently, Surendra Reddy allegedly sold the same property to Bapaya Choudhary on 19.06.2019 for ₹4,63,000/- through a registered sale deed, and Bapaya Choudhary sold it to Sandeep Patil S/o Ramangoda on 17.03.2023 for ₹5,10,000/- through a registered sale deed. 7. Based on the said complaint, the police registered the case and are investigating the matter. The registration of the FIR and investigation thereof is called in question by Sri.Surendra Reddy. 8. Learned counsel Sri.Amit Anandhalli, appearing for the petitioner, reiterating the grounds urged in the petition would vehemently contend that the registration of the FIR is incorrect, as there exists a registered sale deed in his favour and sought for quashing the pending FIR. 9. Learned High Court Government Pleader, appearing for respondent No.1-State and Sri.Vinayak Kulkarni, appearing for respondent No.2, have opposed the quashing of the pending FIR and sought for dismissal of the petition. 10. Having heard the arguments and taking note of the relevant facts, admittedly, there is multiple registered sale deed in respect of the same plot. Whether at all there was an - 5 - HC-KAR NC: 2026:KHC-D:2121 CRL.P No. 101406 of 2025 impersonation or fraud has occurred cannot be decided by this Court at this stage that too while seeking the prayer for quashing of the FIR. 11. Such an enquiry would fall squarely within the domain of the investigation process and are to be determined by the competent investigating agency. 12. In view of the above, this Court does not find any valid grounds whatsoever to quash the pending FIR. 13. Hence, following order is passed: ORDER The petition is dismissed.
