2. The case of the prosecution is that A1 was found in possession of kilograms of ganja, allegedly sourced from Odisha. Based on the proceedings, the contraband and motorcycles were seized and Al, A2 and A4 were arrested. Hence, the case. 3. The learned counsel for the petitioner submitted that the petitioner has been incarcerated since 16.05.2026 and there are about four accused and the petitioner has been arrayed as A4. only on his fault of handing over his two- wheeler, he has been implicated in the case. Hence, he prays for grant of bail to the Petitioner. 4. Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and strongly opposed the bail application on the ground that this petitioner had 100 kg of contraband which comes under commercial quantity. He further submitted that the petitioner has been incarcerated since 16.05.2026. Hence, he opposed the grant of bail to the Petitioner. 5. 6. Considering the facts and circumstances of the case; taking note of the submission made by the learned Government Advocate (Crl.Side); it is observed that the investigation is still pending.
Though the learned counsel for the petitioner submitted that there is no recovery from this petitioner and only from the A1 and A3, considering the fact that investigation is still pending and that being a huge quantity of 100 kg of contraband, this Court is of the firm view it is not appropriate to enlarge the petitioner at this stage. Hence, this Court is not inclined to grant bail to the petitioner. 7. Accordingly, this Criminal Original Petition stands dismissed. The Prison authorities are directed to provide appropriate medical assistance to the petitioner, as per the advice of the prison doctor, if the petitioner has any medical condition. 24-07-2026 SHL To:
