3. The petitioner is the husband and the first respondent is his wife. There is a subsisting matrimonial dispute between the petitioner and the first respondent, which is pending on the file of a different Court. The suit O.S. No. 344 of 2023 on the file of the Additional District Court, Chengalpattu has been filed by the respondents against the petitioner for partition and separate possession of the suit schedule property. 4. During the pendency of the suit, I.A. Nos. 3, 4 and 5 of 2023 were filed by the respondents against the petitioner, seeking for an interim injunction in respect of the schedule mentioned properties. During the pendency of the interlocutory applications, the petitioner claims that he has given an undertaking to the Court that he shall not alienate or encumber the properties till the disposal of the interlocutory applications. 5. The learned counsel for the petitioner would submit that I.A. Nos. 3, 4 and 5 of 2023 were argued by the petitioner's counsel before three different judges and the said interlocutory applications are still pending for almost three years without pronouncement of orders in those applications. He would submit that I.A. Nos. 3, 4 and 5 of 2023 are now posted for orders on 29.07.2026. https://www.mhc.tn.gov.in/judis

No prejudice will be caused to any of the parties if a direction is issued to the Additional District Court, Chengalpattu, to dispose of I.A. Nos. 3, 4 and 5 of 2023 within a time frame to be fixed by this Court. 7. This Court, after giving due consideration to the year of the interlocutory applications and after giving due consideration to the petitioner's contentions that the petitioner's counsel had argued the interlocutory applications before three different judges, is inclined to direct the trial Court to dispose of the applications within a time frame to be fixed by this Court. 8. Since no adverse orders are passed against the respondents, notice to the respondents is dispensed with by this Court. 9. Accordingly, this Court directs the Additional District Court, Chengalpattu, to dispose of I.A. Nos. 3, 4 and 5 of 2023 in O.S. No. 344 of 2023 on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order. https://www.mhc.tn.gov.in/judis
