ORDER This application has been filed to receive the additional documents set out herein below as 1 to 10 and mentioned in the affidavit in C.S.No.15 of 2012. 2.Heard the learned counsel for the applicant who submits that these documents are necessary and the delay in producing these documents are neither wilful nor wanton and sought for allowing this application. 3.Learned counsel for the respondents has opposed for allowing this application stating that these documents are not relevant and this application has been filed only to delay the proceedings and hence, has been filed belatedly and sought for dismissing this application. 4.The only question that arises is whether the belatedly filed documents may be 2/4 https://www.mhc.tn.gov.in/judis

In fact, as the trial court sufficient opportunity should be given to the parties to produce all available evidence; hence, any delay in filing additional documents is condoned and the application is liable to be allowed subject to proof, relevancy and admissibility. 5.However, it is seen that the documents 4 and 5 which are sought to be received are photocopies and hence, could not be marked. Accordingly, the documents 1 to 3, 6 to 10 are directed to be received and marked subject to proof, relevancy and admissibility.
It is needless to say that the secondary evidence are always permissible in law and the parties shall file the same in accordance with law. 6.Accordingly, this application is ordered in the above terms.
