R2 second respondent [2] In the captioned WA and captioned MC thereat, Mr. Deepak Prasad Sahu, learned counsel on record for the appellants/MC applicants is before this Court (physical Court) and Mr. BP Sahu, learned senior advocate appearing on his behalf is also before this Court (physical Court). Page 7 of 9 [3] After some arguments by learned senior counsel, counsel on record Mr. Deepak Prasad Sahu sought leave of this Court to withdraw the captioned WA and the captioned MC thereat but made a prayer to preserve the rights and contentions of the appellants/MC applicants to file an application (MC) before Hon’ble Single Judge with a prayer to advance hearing. Leave to withdraw granted and rights and contentions of appellants/MC applicants are preserved for filing a MC with a prayer to advance the hearing in WP(C) No. 847 of 2024 and 3 (three) MCs thereat viz., MC(WP(C)) No. 769 of 2024, MC(WP(C)) No. 877 of 2025 and MC(WP(C)) No. 901 of 2025. Though obvious, we make it clear that if such an MC is filed, the same will be considered on its own merits and in accordance with law entirely at the discretion of Hon’ble Single Judge concerned untrammeled by instant withdrawal order and preservation of rights herein. To put it differently, it is completely the autonomy of the Hon’ble Single Judge concerned to deal with the MC on its own merits and in accordance with law. [4] Though a withdrawal order albeit with preservation of rights, this Court deems it appropriate to write that Mr. M. Rustam, learned counsel (led by Mr. Kh. Tarunkumar, learned senior counsel) was waiting in court to accept notice for respondents 1 and 2 in captioned WA and captioned MC, if this Court is inclined to issue notice. In the scenario that unfurled, Mr. Tarunkumar, learned senior counsel very fairly submitted on instructions that if a MC (as alluded to, supra) is moved, Mr. Rustam, learned counsel will accept notice and he will appear in the matter. Though obvious, for the sake of specificity it is deemed appropriate to write that all rights and contentions of R1 and R2 also will stand preserved before Hon’ble Single Bench. To be noted, Mr. Rustam led by Mr. Tarunkumar is opposing the afore referred Writ Petition and two MCs and pursuing one MC before Hon’ble Single Bench.
