Kandpal, learned AGA for the State. 3. Present bail application is moved by the applicant, who is in judicial custody in connection with FIR/Case Crime No.03 of 2026 under Section 8/20/60 of Narcotic Drugs and Psychotropic Substances Act, P.S. Mori District Uttarkashi. 4. Learned counsel for the applicant submits that there is no independent witness despite the alleged recovery from a public road. He submits that applicant was kept in police station for a long time and forced to sign blank and typed documents; he submits that applicant was not given the benefit of Section 50 of the NDPS Act; the said contraband was not recovered from the applicant. He submits that the arrest memo and the inventory report already contained the FIR number, which creates a doubt in the prosecution story. He further submits that applicant is languishing in jail since 03.03.2026 and has no criminal history. 5. Learned State counsel opposed the bail application stating that the contraband i.e. charas recovered from the possession of the applicant is of a huge quantity, thus applicant is not entitled to be released on bail. 6. Having considered the overall facts and circumstances of the case; without entering into the merits of the case and considering the fact that the arrest memo and inventory report already contained the FIR number, this Court is of the view that applicant is entitled to be released on bail. 7. Accordingly, bail application is allowed. Let the applicant-Ayush Thakur be released on bail on his executing a personal bond and two reliable sureties of the like amount to the satisfaction of the court concerned. 8.
