(2) Petitioner made representation regarding his reinstatement before General Manager, Bazpur Cooperative Sugar Factory Ltd. His representation was rejected vide order dated 6.5.2023. The reason assigned for rejecting petitioner’s representation is that against the award rendered by learned Labour Court, sugar mill has filed Writ Petition (M/ S) No. 1536 of 2020. By its award, learned Labour Court held that the actual date of birth of petitioner is 1.7.1968 and he was wrongly made to retire in the month of May, 2022. (3) Since Writ Petition (M/ S) No. 1536 of 2020, filed by Bazpur Cooperative Sugar Factory Ltd., has been dismissed by an order of even date, therefore, the reason assigned for rejecting petitioner’s representation does not hold good any further. In such view of the matter, writ petition is disposed of by directing the General Manager, Bazpur Cooperative Sugar Factory Ltd. to reconsider petitioner’s representation and take decision on the same, as per law, within four weeks from the date of presentation of certified copy of this order.
