The wife seeks transfer of GWOP No.26 of 2026 filed by the respondent/husband pending on the file of Principal District Court, Tiruppur as well as HMOP No.292 of 2025 pending on the file of Sub Court, Pollachi to the file of Family Court, Coimbatore. 3. Learned counsel for the respondent/husband states that in principle, the respondent/husband has no serious objections for the transfer to be made. Learned counsel for both the parties state that since the matter is being transferred to Family Court, Coimbatore from the Sub Court and Principal District Court respectively, the presence of parties may not be insisted ordinarily except where their presence would be required for recording the evidence in chief and cross. 4. Accordingly, Tr.C.M.P.Nos.391 and 400 of 2026 are allowed and the proceedings in HMOP No.292 of 2025 is withdrawn from the file of Subordinate Court, 2/4 https://www.mhc.tn.gov.in/judis TR CMP Nos. 391 and 400 of 2026 Pollachi and the same is transferred to Family Court, Coimbatore and GWOP No.26 of 2025 is withdrawn from the file of Principal District Court, Tiruppur and the same is transferred to Family Court, Coimbatore. 5. It is made clear that both the petitioner and the respondent are entitled to engage a counsel of their choice before the Family Court, Coimbatore who shall ordinarily represent them for regular hearings and the petitioner and the respondent shall make themselves available physically whenever their presence is necessary for recording their evidence either in chief or cross. 6. The Principal District Court, Tiruppur is directed to transfer the entire records relating to GWOP No.26 of 2025 and the Subordinate Court, Pollachi is directed to transfer the entire records relating to HMOP No.292 of 2025 to Family Court, Coimbatore forthwith.
