(2) Petitioner has challenged appointment of respondent no. 6 on the post of Anganwadi Karyakarti on the ground that selection committee was not properly constituted. (3) Learned State Counsel, however, refers to Clause 4(1) of Part-4 of Government order dated 20.2.2023 for contending that for upgrading Anganwadi Sahayika to the post of Anganwadi Karyakarti, selection process is not to be undertaken and Anganwadi Sahayika can be directly appointed as Anganwadi Karyakarti, based on her performance and willingness. Learned State Counsel refers to proviso to Clause 4(1) and submits that in the present case, comparative merit of petitioner and respondent no. 6 was ascertained based on quality point marks and since score of respondent no. 6 was higher, therefore, she was appointed as Anganwadi Karyakarti. Learned State Counsel further refers to letter dated 18.4.2023, issued by Director, Women Empowerment and Child Development, for contending that while upgrading Anganwadi Sahayika as Anganwadi Karyakarti, formal selection process is not to be undertaken. 2026:UHC:3754 (4) In view of the policy contained in the above referred Government Orders, this Court does not find any reason to disturb the appointment of respondent no. 6. However, writ petition is disposed of granting liberty to petitioner to approach the competent authority by making a representation, which, if made within two weeks from today, shall be decided within four months.
