1. With the consent of both parties, the present civil writ petition is disposed of in the following terms: (i) The order dated 26.09.2025, is quashed and set aside. The additional issue, as framed by the learned Appellate Rent Tribunal, is remitted back to the learned Rent Tribunal. (ii) The parties are at liberty to lead evidence on the said issue, as framed by the learned Appellate Rent Tribunal.
[2026:RJ-JP:7918] (2 of 2) [CW-18780/2025] (iii) After the evidence is presented, the learned Appellate Rent Tribunal shall remit the evidence along with its findings to the learned Appellate Court. (iv) The learned Appellate Rent Tribunal shall then decide the appeal in accordance with law, as per the provisions of Order 41 Rule 25 of the CPC.
