JUSTICE DEVASHIS BARUAH ORDER Date : 12.05.2026 Heard Mr. D. Gogoi, the learned counsel appearing on behalf of the Applicants/Petitioners. Mr. D. Senapati, the learned Standing Counsel appears on behalf of the Respondent Nos. 2, 3 and 4 and Mr. A.R. Gogoi, the learned counsel appears on behalf of the Respondent No. 5. 2. The present application though registered as a review application is essentially an application seeking modification of the liberty granted by this Court in the judgment and order dated 08.08.2023 passed in WP(C) No. 934/2011, whereby this Court had granted liberty to the Petitioners/Applicants to submit a representation before the Chairman and Managing Director of the Respondent No. 5, i.e., the Chairman-cum-Managing Director of NHPC. It is the case of the Applicants herein that the liberty ought to have been granted to the Applicants to submit a representation before the Chairman-cum-Managing Director of NEEPCO, inasmuch as the Petitioners are still rendering their services under NEEPCO. 3. Pursuant to certain orders passed by this Court, and more Page No.# 4/4 particularly the order dated 05.03.2026, it has been ascertained that the Applicants/the Petitioners are actually working in the Tuirial Hydro Electric Project of NEEPCO in Mizoram. 4. Considering the above, this Court is of the opinion that the interest of the review Applicants/Petitioners would be better served if the representation is filed before the Chairman-cum- Managing Director of NEEPCO. 5. Accordingly, the liberty so granted to the Petitioners/Applicants to file a representation before the Chairman and Managing Director of NHPC stands modified, and liberty is granted to the Applicants/the Petitioners to file a representation before the Chairman-cum-Managing Director, NEEPCO. 6. The instant order shall form a part of the Judgment and Order dated 08.08.2023 passed by this Court in WP(C) No. 934/2011. 7. With the above, the instant application stands disposed of.
