The petitioner is apprehending his arrest in connection with Complaint Case No. 1065 of 2025, registered for the offence under Sections 64, 303(2), 115, 116, 351(2), 191, 191(2), 3(5) of Bhartiya Nyaya Sanhita, 2023, pending in the Court of learned Chief Judicial Magistrate, Giridih. 3. Learned senior counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case. He submits that the allegations are made that the petitioner and informant become friend in the year 2023 and thereafter, they were having the relationship. He submits that the allegations are made that on false pretext of marriage, the relationship was established however, the complaint case was lodged on 03.06.2025 which has been converted into FIR. He also draws the attention of the Court to paragraph 84 of the case diary and submits that the father of the informant has been examined and has not supported the case. 4. Learned Special P.P., who appeared for the State through video conferencing and learned counsel for the informant have vehemently opposed the prayer and submit that the allegations are thereof establishing of the relationship on false pretext of marriage 5. Looking into the content of the complaint case which has been converted into FIR, it transpires that relationship was established on 13.05.2023 itself, wherein complaint case has been lodged on 03.06.2025, in para 82 of the case diary even the father of the informant 2026:JHHC:9426 has disclosed that he is having no knowledge about the allegation made by the informant and in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
