1. Mr. Shariq Khurshid, learned counsel for the petitioners.
2. Mrs. Meenakshi Sharma and Mr. Himanshu Sain, learned A.G.A. for the State.
3. Mr. Prince Chauhan, learned counsel for the complainant.
4. The instant petition has been moved by the petitioners for quashing of first information report dated 26.09.2025 bearing FIR No. 0324 of 2025, P.S. Kunda District Udham Singh Nagar wherein the petitioners have been implicated for the offences punishable under Sections 420 and 504 of IPC.

The writ petition is supported with the compounding application and the affidavit of the petitioners and respondent no.3 wherein it is contended that they have settled their disputes and the name of respondent/complainant has already been recorded in the revenue record and the construction has already been started. The petitioners and the respondent no.3/complainant are present in Court and are identified by their respective counsels.
6. It is contended in the compounding application that the parties have settled their disputes, therefore, the FIR be quashed.

7. This Court also interacted with the complainant who submits that she does not want to pursue the complaint and requested that proceedings pursuant to the impugned FIR be quashed.

On the other side, Mrs. Meenakshi Sharma, the learned A.G.A. submits that both the offences are compoundable, and since they settled their disputes which prima facie appears to be of civil in nature and the complainant does not want to pursue the impugned FIR, therefore there is no useful purpose to go with the investigation.
9. In such view of the matter, when the parties have settled their disputes and both the offences are compoundable, this Court is of the view that the compounding application as well as writ petition deserves to be allowed.
10. Accordingly, the writ petition as well as the compounding application are allowed and the impugned first information report dated 26.09.2025 bearing FIR No. 0324 of 2025, P.S. Kunda District Udham Singh Nagar is hereby quashed.
