C.M.A.2606 OF 2026 Judgment (Judgement of the Court was made by N.Sathish Kumar J.) A Joint Memo of Compromise dated 28.07.2026 is filed by both the parties (viz., the appellant/Insurance Company and the contesting respondent, viz., first respondent/claimant, which has been duly signed by them parties as also by their respective counsel. So far as the second respondent, owner of the vehicle is concerned, he has already been set ex parte before the Tribunal. 2. The appellant and the first respondent are present before us today and they accepted the terms of the Joint Memo of Compromise. The respective parties are also identified by their Counsel. 3. As per the aforesaid Joint Memo of Compromise, the first respondent/claimant is ready and willing to accept a sum of Rs.38,00,000/- (Rupees Thirty Eight Lakh only) as full quit including the statutory deposit towards the claim for compensation. 2/5 https://www.mhc.tn.gov.in/judis

4. Therefore, we are inclined to dispose of this Civil Miscellaneous Appeal as per the terms of the compromise arrived at between the parties. 5. Accordingly, this Civil Miscellaneous Appeal is disposed of in terms of the aforesaid Joint Memo of Compromise dated 28.07.2026. The aforesaid Joint Memo of Compromise shall form part of the decree.
Since as per the said Joint Memo of Compromise, the appellant-Insurance Company has agreed to deposit the aforesaid amount to the credit of M.C.O.P.No.110 of 2019 on the file of Motor Accidents Claims Tribunal, Additional District Court, Chengalpattu, within a period of four weeks from the date of receipt of a copy of this order, as and when such deposit is made, the first respondent/claimant is permitted to withdraw the entire amount, for which sake, the Tribunal is directed to issue the cheque to the first respondent, by name, K.Pown forthwith on proper identification in accordance with the terms of the compromise on proper application without any delay. 6.
