At this stage, learned counsel for the applicant seeks permission to withdraw the instant application by reserving right of the applicant to avail appropriate remedy including pursuing the petition already filed, which is pending adjudication in this High Court. 1 Whether the reporters of the local papers may be allowed to see the judgment? 2 2026:HHC:14486 Accepting the prayer, the instant application is disposed of in terms of the prayer. CWP No. 12361 of 2025 This petition has been preferred by invoking the provisions of Article 226 of the Constitution of India for quashing the impugned Notification dated 13.1.2022 (Annexure P-1), whereby in pursuance of the impugned Notification dated 24.12.2020 and recommendation made by Eco-Sensitive Zone Around Protected Areas (Wildlife Sanctuaries/National Parks/Tiger Reserves) in its 46th meeting held on 25.6.2021. Eco-Sensitive Zone has been notified along with boundary details therein in the attached schedule. The aforesaid Notification was assailed in CWP No. 9434 of 2025, titled Gram Panchayat Bhatanwali & others Vs. Union of India and others, which has been decided by this Court on 16.4.2026 and the Notification impugned in the present petition has been quashed and set aside. In view of the aforesaid facts and circumstances of the case, it is undisputed that the lis in the present petition is squarely covered by the judgment dated 16.4.2026, passed in CWP No. 9434 of 2025 referred supra and accordingly the present petition is also allowed with the observation that the findings returned in the said judgment shall apply as mutatis mutandis in the present case also. 3 2026:HHC:14486 Accordingly, the instant writ petition is allowed by quashing the impugned Notification dated 13.1.2022 ( Annexure P-1) along with pending miscellaneous applications, if any, in the same terms.
