For Petitioner(s): Mr. M.Vijaya Ragavan For Respondent(s): Mr.R.Rajasekaran, Counsel for Government of Tamil Nadu (Criminal Side) for R1 Mr. Gubanthiran V For R2 https://www.mhc.tn.gov.in/judis CRL OP No. 9601 of 2026 __________ Page2 of 4 ORDER 1. This Criminal Original Petition seeks to quash the F.I.R. in Crime No.893 of 2020 on the file of the 1st respondent police for alleged offences under Sections 75(1)(c) of Tamil Nadu City Police Act, 1888 and Sec.341, 323, 427 and 506(ii) of I.P.C. and Sec.4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002 on the ground of compromise between the parties. The parties are present before the court and, on examination, stand by their compromise and do not want the case to proceed further. 2. The broad contours of the High Court's power to exercise extraordinary jurisdiction under Section 482 of the Cr.p.c. and Section 528 of the BNSS in respect of compromise of non-compoundable offences are laid down by the Hon’ble Supreme Court of India in Gian Singh -Vs- State of Punjab and Another (2012 10 SCC 303) and other subsequent judgments. 3. The gist of facts leading to the instant case are that there are commercial transactions between the de facto complainant side and the accused side. While so, when the de facto complainant was travelling in a car with her husband, all these accused have said to have restrained them, surrounded them and also https://www.mhc.tn.gov.in/judis CRL OP No. 9601 of 2026 __________ Page3 of 4 threatened them and snatched their cell phone and attempted to abduct the de facto complainant. 4. The de facto complainant appeared before this Court would submit that upon the threat being made, she fainted and did not recall all the instances of the incident. She would further submit that as far as the present petitioner/accused No.2 is concerned, he was merely present in the spot and did not commit anything. Therefore, she has ironed out the differences with the 2nd accused. 4. Thus, it can be seen that this matter is a fit case for the exercise of extraordinary jurisdiction to quash the case on compromise. 5. Accordingly, this Crl.O.P. No.9601 of 2026 stands allowed. As against this petitioner alone, the F.I.R. in Crime No. 893 of 2020 on the file of the Inspector of Police, Kattoor Police Station, Coimabtore City stands quashed. 28-07-2026 Neutral Citation: Yes/No RPP To 1.
