The prayer in the Criminal Original Petition is to withdraw the Special SC No.130 of 2026 on the file of the learned Special Judge, POCSO Court, Coimbatore to the file of the learned Mahila Cour/Special POCSO Court, Chennai. 2, The petitioner is facing an offence punishable under Section 10 of the POCSO Act. The victim child has alleged that the petitioner being the Physical Education teacher inappropriately touched her breasts, on account of which, the petitioner is facing the charge. Now the ground on which the petitioner seeks transfer is that his father, who is aged about 80 years is ill and is stationed at Chennai and the petitioner has to take care of his father. 3. I have considered the said submission. The illness of the father cannot be a ground to transfer the case, especially when the trial is proceeding before the learned Special Court at Coimbatore. the prayer cannot be acceded to. If the petitioner is unable to be present on any hearings, provided that his absence is not not an issue and the case could be proceeded further and for such hearings, if it is https://www.mhc.tn.gov.in/judis CRL OP No. 20143 of 2026 __________ Page3 of 4 pleaded that if the petitioner has to attend to his ailing father, the application under Sec.317 can be considered by the trial court to condone his absence and be represented by his counsel. 4. With the above observation, the transfer petition merely on the ground of father’s illness cannot be entertained and as such, this Criminal Original Petition is disposed of.
