Ms. Mamta Bisht, learned counsel for the petitioner. 2. Mr. Himanshu Sain, learned A.G.A. for the State. 3. The local police already investigating the FIR dated 24.02.2026, bearing FIR No. 0004 of 2026 registered at P.S. Baijnath District Bageshwar which was lodged by one Keshar Singh Koranga implicating her daughter-in- law Deepa for the offence punishable under section 103(1) of BNS 2023. 4. In this petition, the petitioner is praying for transfer of investigation to any independent investigating agency, like, CBCID or SIT. The allegation is with regard to the killing of 22 days old child and the person who is implicated in the FIR is the mother of the deceased child. 5. On the previous date the State counsel was directed to get instructions and today on instructions he submits that investigation is still going on but up till date no such material has been collected so far against the mother of the deceased child. 6. Apart from this Mr. Sain, learned A.G.A submits that after death, inquest report was prepared which is also on record and while preparing the inquest report the complainant was also present and during interrogation he also stated that after taking milk the deceased child vomit and thereafter referred to the Community Health Centre Baijnath where the infant child declared dead. 7. Be that as it may, the investigation is still carried out in a fair manner and the FIR has been lodged only on 24.02.2026, therefore, filing of this petition for transfer of 2026:UHC:3606 investigation to the CBCID or SIT is completely an abuse of process of law, since, investigation is only at a preliminary stage. 8. I found force on the submission of learned State Counsel and, as such, I do not find any merit in this petition and the same is accordingly dismissed.
