The present Special Leave to Appeal has been filed under Section 419(4) of the Bharatiya Nagarik Suraksha Sanhita, 2023, challenging the judgment and order dated 10.03.2026 passed by the learned First Additional District and Sessions Judge, District Haridwar, whereby the accused in Sessions Trial No. 298 of 2022 and the co-accused in Sessions Trial No. 64 of 2023 have been acquitted of the offences punishable under Sections 498-A, 307/ 34, 323/ 34, 504 and 506 of the IPC. 4. As per the office report dated 08.05.2026, notice has been duly served personally upon Respondent Nos. 2 to 5. However, despite service being sufficient, none has put in appearance on their behalf. 5. Upon consideration of the submissions advanced by learned counsel for the Appellant and upon perusal of the material available on record, this Court is of the view that, at this stage, sufficient grounds exist for grant of leave. Accordingly, the Special Leave to Appeal is granted. 6. Though none has appeared on behalf of Respondent Nos. 2 to 5 despite sufficient service, yet in the interest of justice, one more opportunity is granted to the said Respondents to appear and contest the matter, if they so desire. 7. The Registry is directed to prepare the paper book and furnish copies thereof to learned counsel for the parties in accordance with the Rules. 8.
