Mohanty, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 24.03.2026 01. 1. Heard learned counsel for the petitioners and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Deogaon P.S. Case No.01 of 2026 corresponding to G.R. Case No.07 of 2026 pending in the court of learned S.D.J.M., Balangir on the grounds stated. 3. Perused the FIR as at Annexure-1. A copy of the bail order in respect of two other accused persons of the Sessions Court is produced. It is submitted that though all the offences are bailable in nature but the accused persons on bail were forwarded for an offence punishable under Section 109(1) BNSS, hence, the petitioners, who are similarly situated, apprehend their arrest in the hands of the local police. A copy of the bail order of the learned District and Sessions Judge, Balangir in BA No.16 of 2026 is produced and the same is perused and it reveals that the injury to be simple in nature. It is mentioned therein that the injuries are abrasions only. Gone through the FIR as at Annexure-1. The involvement of the petitioners is alleged therein with other accused persons. The reason behind the alleged incident is narrated therein. Considering the same and objection of the State and submission of Mr. Banji, learned counsel for the petitioners, this Court even though not inclined to grant pre-arrest to any of them but is of the view that they should be directed to surrender before the learned court below for being released on similar terms and conditions like the co-accused, namely, Tirtha Shankar Bagarty and Rajendra Sandh. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioners surrender before the court of learned S.D.J.M., Balangir in connection with Deogaon P.S. Case No.01 of 2026 corresponding to G.R. Case No.07 of 2026 within a fortnight from today, they shall be released on bail upon furnishing bail bonds of Rs.20,000/-(rupees twenty thousand) each with one solvent surety for the like amount each with other conditions imposed as deemed just and proper in the facts and circumstances of the case. 6.
