Hoque, learned counsel for the petitioner and Mr. B. Sarm, learned Additional Public Prosecutor, Assam. 2. This is an application filed under Section 483 of the BNSS, 2023, praying for grant of bail to the accused/petitioner, namely, Sabdul Ali @ Chabdul Ali in connection with Laluk P.S. Case No. 75/2026 registered under Sections Page No.# 2/3 178/179/180 of the BNS, 2023. 3. Case Diary received. Perused the same. 4. It is submitted by Mr. Hoque, learned counsel that the present petitioner is innocent and he has no connection with the alleged offence. It is a fact that some fake currencies were recovered from a vehicle, which was parked in front of his house and the fake currency notes were recovered and seized at around 11:00 p.m., when the petitioner was sleeping in his house and he was not aware about any fake currencies kept in the said vehicle. 5. He further submitted that the accused petitioner is in custody since last 40 days including 3 days police remand and hence, the I.O. got sufficient opportunity to interrogate him, keeping him in custody. 6. He further submitted that he is willing and interested to cooperate with the I.O. in further investigation of the case, if he is granted with the privilege of bail. There was no recovery from the conscious possession of the petitioner and he is not even the owner of the said vehicle, which was parked in front of his house. 7. Mr. Sarma, learned APP raised objection and submitted that there are sufficient incriminating materials against the petitioner and the case is still under investigation. He further submitted that from the forwarding report of the petitioner and the statement made in para 7 of the petition also, it reveals that owner of the vehicle is one Sukur Ali, is the own brother of the petitioner. 8. He further submitted that the other two co-accused persons of the case are still absconding and they are yet to be apprehended by the I.O. He further submitted that the case is registered under Sections 178/179/180 BNS, wherein, Section 179 is an offence punishable with life imprisonment. He further Page No.# 3/3 submitted that the case is very serious in nature wherein Rs.1,75,000/- fake currency notes were recovered from the possession of the petitioner and this is an offence against the Nation. Mr. Sarma accordingly raised vehement objection and submitted that it is not at all a fit case to allow the petitioner to go on bail at this stage. 9. Mr. Hoque, learned counsel however, submitted that the said Sukur Ali is not his own brother and he may be son of another Raham Ali and he is not the brother of the present petitioner. 10. Considering the submissions made by the learned counsel for the parties, materials available in the case diary, recovery of the fake currency notes from the possession of the petitioner and other aspects of the case, it is seen that further custodial interrogation of the petitioner may be necessary to unearth some more facts of the case and also to apprehend the other co-accused of the case, who are still absconding. The case is still at the stage of investigation and further custodial interrogation of the petitioner may be necessary. 11. Accordingly, this bail application of the petitioner, Sabdul Ali @ Chabdul Ali in connection with Laluk P.S. Case No. 75/2026 stands rejected. 12. Return the case diary. JUDGE Comparing Assistant
