ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the 2nd respondent to consider the petitioner's representation dated 13.05.2024 within a time frame to be stipulated by this Court.
2. The case of the petitioner is that the property measuring an extent of 37 cents (or 0.15.0 Ares), comprised in Punjai Survey No. 196/7H, situated at Manamadurai Village, Keezhkalathur Madura, Nemili Taluk, Ranipet District, belonged to the petitioner’s father, namely, Chinnappa, vide Patta No. 464 in Patta Pass Book bearing No. 12453 issued by the third respondent under the Tamil Nadu Patta Pass Book Act, 1983. Such being the case, when the 11th respondent attempted to interfere with the petitioner's family's possession and enjoyment of the property, the petitioner lodged a police complaint against him before the Inspector of Police, Arakkonam Taluk Police Station. During the enquiry therein, the petitioner came to know that the third respondent had issued multiple pattas to various persons—more particularly to respondents 4 to 12— by sub-dividing the said property, despite the said private respondents having no right or title over the same. In this regard, the petitioner submitted a __________ Page4 of 7 https://www.mhc.tn.gov.in/judis
WP No. 28348 of 2026 representation dated 13.05.2024 to the second respondent. However, despite the lapse of a considerable period, the same has not been disposed of till date. Aggrieved by the inaction on the part of the second respondent, the petitioner has been constrained to file the present Writ Petition
3. Ms.Inthu Karunakaran, learned Government Counsel appearing for the official respondents, submitted that the representation of the petitioner dated 13.05.2024 would be considered by the 2nd respondent and appropriate orders would be passed thereon, on merits within a period of twelve weeks, after issuing notice to the private respondents.
4. Considering the facts and circumstances of the case and the
submissions made on either side, this Court, without going into the merits of the matter, directs the 2nd respondent to consider the petitioner’s representation dated 13.05.2024. The 2nd respondent shall pass appropriate orders on merits and in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner as well as the respondents 4 to 12 and affording them an opportunity of a personal hearing. __________ Page5 of 7 https://www.mhc.tn.gov.in/judis
