3. Petitioner was enrolled in Indo- Tibetan Border Police Force (ITBP) on 09.01.2025 and he was thereafter sent for training to Basic Training Centre, Karera in State of Madhya Pradesh.

According to the petitioner, the instructors at Karera are mistreating him and petitioner as well as his father had also made request to change the training centre allotted to petitioner, but, no decision is being taken. In this writ petition, petitioner has challenged the communication dated 09.01.2026, issued by Adjutant, 61st Battalion, ITBP, whereby he was asked to report for duties in 61st Battalion, on or before 12.01.2026.

Learned counsel for the petitioner contends that the said letter was dispatched on 13.01.2026, therefore, it was not possible for the petitioner to report for duties on 12.01.2026, as
directed by the letter.
6. Mr. Lalit Sharma, learned Deputy Solicitor General of India appearing for the ITBP, however, submits that on earlier occasion also, petitioner remained unauthorisedly absent from the training centre and he is now offering lame
2026:UHC:1285 excuses for his absence. He, however, concedes that if petitioner makes representation to the competent authority, then decision shall be taken, as per law.
7. Accordingly, the writ petition is
disposed of by permitting petitioner to make representation to respondent no. 3 within ten days from today. If petitioner makes representation within the stipulated time, decision thereupon shall be taken by respondent no. 3, as per law, within three weeks thereafter. It shall be open to the petitioner to submit representation through e-mail.
