The Transport Commissioner preferred the present writ appeal challenging the writ order dated 22.07.2024 passed in W.P.No.5029 of 2024. 2. The respondent filed the writ petition challenging the order dated 19.02.2024 issued by Transport Commissioner deferring his promotion to the post of Superintendent for the panel of the year 2016-2017. A deferred list was issued by the Transport Commissioner, vide proceedings dated 19.02.2024. The name of the respondent Mr.A.Samuvel is found in Serial No.20. The reason for deferring his promotion is stated as “TDP Case pending in R.No.1949/VA2/2019”. Since the disciplinary proceedings were pending before the Tribunal during the relevant point of time, the name of the respondent was not considered to the post of Superintendent. 3. It is brought to the notice of this Court that the respondent was subsequently, removed from service. That being the factum, this Court does not find any infirmity in respect of the order dated 19.02.2024, deferring the name of the respondent for grant of promotion to the post of Superintendent. 4. In view of the above factual position, the writ order impugned dated 22.07.2024 passed in W.P.No.5029 of 2024 is set aside and the Writ Appeal stands allowed. No costs.
