Mr. S. Hoque, the learned counsel appearing on behalf of the petitioner submitted that taking into account that the petitioner could not participate in the tender process in view of the conditions which were challenged in the present proceeding and as no stay was granted, the petitioner would not like to pursue with the instant writ petition, however, keeping the question in the present writ petition open for consideration in any subsequent proceeding, if occasion so arises.
2. Taking into account the above, the instant writ petition stands closed on withdrawal.
3. The liberty as sought for is granted.
