3. Petitioner took a loan under Prime Minister Employment Guarantee Scheme from Union Bank of India. According to the petitioner, the said loan account has been classified as ‘fraud’ by the concerned bank. Petitioner is apprehensive that the bank may lodge an FIR against him.
4. Learned counsel appearing for petitioner submits that even though the loan was taken by petitioner under Prime Minister Employment Guarantee Scheme, however, he misused the loan amount by diverting it to the saving bank account of his father and relatives, which is not permissible as per RBI Guidelines. He, however, submits that if petitioner has any grievance, then he could have approached the competent authority in the bank instead of rushing to this Court.
5. The writ petition is, accordingly, disposed of by permitting the petitioner to make representation to the Manager of the concerned branch. If he makes representation within two days from today, decision thereupon shall be taken, as per law, within a week thereafter.
